These Terms of Use ("Terms") govern your use of kasoyahealth.com (the "Site") operated by Kasoya Health PLLC, a Texas professional limited liability company ("Kasoya Health," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
EMERGENCY NOTICE: This Site is informational. If you are experiencing a medical emergency, call 911 (United States) or 911 / 060 (Mexico) immediately. Do not use this Site, the inquiry form, or WhatsApp links to communicate emergencies.
1. Site is informational, not medical advice
Content on this Site is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Reading this Site does not create a physician-patient relationship between you and Dr. Omar Matuk-Villazon or Kasoya Health. A physician-patient relationship is established only through formal scheduling, intake, payment, and clinical encounter.
2. No insurance billing
Kasoya Health is a direct-pay practice. We do not bill private insurance, Original Medicare, Medicare Advantage, or any Medicare program. Patients are responsible for payment at the time of visit. We may provide itemized superbills upon request for potential out-of-network or HSA/FSA reimbursement.
3. Telehealth and cross-border care
Dr. Matuk-Villazon is licensed in Texas (United States) and Mexico. Telehealth visits are limited by the licensure rules of each jurisdiction. Patients located outside Texas or Mexico at the time of a visit may not be eligible for clinical care via this practice. Please confirm your physical location at the time of any telehealth visit.
4. Use of the Site
You may use the Site only for lawful purposes. You agree not to (a) attempt to scrape, crawl, or systematically extract data; (b) reverse-engineer, disassemble, or attempt to discover source code or non-public components; (c) interfere with or disrupt the Site or servers; (d) impersonate any person or entity; (e) use the inquiry form or WhatsApp link for spam, harassment, or unlawful communication.
5. Intellectual property
All content on the Site, including text, design, logos, photographs, and code, is owned by Kasoya Health PLLC or licensed to us. You may not copy, redistribute, modify, or use this content for commercial purposes without our prior written consent. Limited personal use (such as printing a page for your records) is permitted.
6. Inquiry-form and WhatsApp submissions
Information you submit through the inquiry form or WhatsApp is used solely to respond to you. Do not include sensitive medical information, diagnoses, medications, or any Protected Health Information (PHI) in these channels — they are not secure medical channels. For clinical communication, established patients must use the patient portal.
7. Third-party links and services
The Site links to third-party services (Elation EMR patient portal, Elation pay-bill page, WhatsApp). We are not responsible for the content, privacy practices, or availability of any third-party site or service. Your use of those services is governed by their terms.
8. Disclaimer of warranties
The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by Texas law, Kasoya Health PLLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for medical malpractice arising from the actual delivery of clinical care, which is governed by the Texas Medical Liability Act and applicable Mexican law.
10. Indemnification
You agree to indemnify and hold harmless Kasoya Health PLLC, its members, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. The exclusive venue for any dispute arising out of or related to these Terms is Harris County, Texas.
12. Dispute resolution — binding arbitration
Except for claims that may be brought in small-claims court or actions to enjoin infringement of intellectual property rights, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or Kasoya Health's services shall be resolved by binding arbitration administered in Harris County, Texas, under the Commercial Arbitration Rules of the American Arbitration Association. Each party will bear its own costs and attorneys' fees, except as otherwise provided by law. YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE THE RIGHT TO A JURY TRIAL OR CLASS ACTION.
13. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and Non-Discrimination Notice, constitute the entire agreement between you and Kasoya Health PLLC regarding use of the Site.
14. Changes to these Terms
We may update these Terms. The effective date at the top of this page reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.
